Standard Possession Order

Standard Possession OrderIn Texas, possession or visitation rights are covered by what is called the Standard Possession Order. Unless otherwise agreed upon by the parties involved, the courts will assume the Standard Possession Order is in effect when determining the visitation rights for the non-custodial parent. The law stipulates that if the two parents live within 100 miles of each other, that the non-custodial parent shall have access to their child that includes:

  • Visitation on the 1st, 3rd, 5th weekends of the month. A weekend is considered to be 6 p.m. Friday to 6 p.m. the following Sunday.
  • Every Wednesday evening during the school year
  • Thirty (30) days in the summer
  • Mother’s/Father’s Day
  • Part of the child’s birthday
  • Major holidays and winter breaks are either split or alternated each year.

The Standard Possession Order was designed to streamline and simplify the visitation process. Of course, willing parties can propose alternate visitation plans, but both parties need to come to a compromise. Even then there are numerous variations which the courts will accept.
