Texas State Guidelines for Child Support

The State of Texas is very clear on the guidelines for child support. Most child support statutes take into consideration the monthly income of the obligated parent, with a cap of 6,000 dollars a month. Based on this amount, the number of children, and the general situation of the divorce, the obligated parent must pay at least 20% of their net resources to the parent with the possession of the child. Although there are many diverse variables to consider, most courts will follow the following breakdown:

  • 1 Child of the Marriage 20% of Net Resources
  • 2 Children of the Marriage 25% of Net Resources
  • 3 Children of the Marriage 30% of Net Resources
  • 4 Children of the Marriage 35% of Net Resources
  • 5 Children of the Marriage 40% of Net Resources
  • 6 Children of the Marriage 45% of Net Resources

Furthermore, the child must have health care, and the payor must provide it if is not available through the payee’s employer. These obligations must be paid until the child reaches 18 years of age or graduates from high school.

Should either party desire an adjustment of child support, they must petition the court for a reexamination of the situation, and provide proof of the change in circumstances.
