Temporary AlimonyDuring a marriage, the finances of two partners are often extremely intertwined. Unfortunately, a separation often complicates who benefits from mutually held investments, interest, and other financial holdings. Fortunately, the law provides a solution for this transitory inequity with a ruling called Temporary Alimony.

Temporary Alimony, or alimony pendente lite, is a financial settlement provided during the early stages of separation but before the divorce is finalized. This agreement can be reached between the two contesting parties, or can be the result of an impartial ruling. This type of alimony is granted to the disadvantaged partner to pay for necessities of life, such as mortgage, utilities, and food until the court reaches a final decision.

Pendente lite is a Latin term for “pending the suit,” which applies to temporary alimony because the court uses it to temporarily pay for the living expenses of the disadvantaged party before a final decision is made of the necessary division of assets and liabilities. The amount of money or support is based on the need of the disadvantaged party, but judges may use their discretion on what constitutes “disadvantaged.”

After the divorce is finalized, the temporary alimony is discontinued in favor of continued spousal support or if the two parties reach a mutual agreement on the distribution of assets and finances. In any case, temporary alimony is often strenuously contested aspects of a divorce, so it is incredibly important to have experienced legal counsel throughout the proceedings.
